Terms of Service

1. What AbhiKai provides

AbhiKai is software delivered over the internet that helps a business capture leads, assign them to salespeople, record the work done on them, and report on the outcome. AI features assist with prioritising leads, drafting notes and drafting messages.

Only the services marked live on our services pages are available today. Services marked as coming soon are described for transparency about our roadmap and are not part of what you are buying.

2. Words we use

A few terms appear throughout:

• Workspace — the isolated area holding one business's data.
• Owner — the person who created the workspace and controls billing and membership.
• Member — anyone invited into a workspace, with a role of Manager, Team Lead or Sales.
• Lead data — the personal information about your prospective customers that you put into AbhiKai.
• Your content — everything you and your members upload, enter or generate inside your workspace.

3. Your account

You must be at least 18 years old and able to enter a contract. You are responsible for the accuracy of your account details, for keeping your password secure, and for everything done under your account.

Tell us promptly if you believe an account has been accessed without permission. You may not share one login between several people — invite them as members instead, which is free of per-seat charges.

4. Workspaces, roles and who sees what

The Owner controls a workspace: who is invited, what role they hold, and what happens to the data. Roles limit access — a Sales member sees only leads assigned to them, a Team Lead sees their team, and Owners and Managers see the whole workspace.

If you are a member of a workspace you did not create, the Owner controls that data and may remove your access or export, edit and delete records including your activity. Where a workspace belongs to your employer, your employer decides what happens to it.

5. Acceptable use

You agree not to:

• Upload contacts you have no lawful basis to contact, or buy and load scraped or rented lists.
• Send unsolicited bulk messages, or continue messaging someone who has asked you to stop.
• Use AbhiKai for anything unlawful, deceptive, or in breach of a platform's rules — including WhatsApp, Meta and Google policies.
• Attempt to access another business's workspace, probe or load-test our systems without written permission, or work around usage limits.
• Resell or provide access to AbhiKai as your own service without a written agreement with us.
• Upload malware, or content that infringes someone else's rights.

6. Your data stays yours

You own your content. We do not sell it, we do not share it with other customers, and we do not use the contents of your workspace to train general-purpose AI models.

We process your content only to provide the service to you: storing it, showing it to the members you authorise, running the AI features you use, sending the messages you ask us to send, and producing your reports. You can export your data while your account is active.

7. Lead data and consent — your responsibility

This is the most important obligation in these terms. The people whose details you put into AbhiKai are your contacts, not ours. In data protection terms you decide why and how their data is processed, and we process it on your instructions.

You are responsible for having a lawful basis to hold and contact them, for honouring opt-outs, and for answering their requests about their own data. We give you the tools — consent records, opt-out handling, export and deletion — but we cannot make those judgements for you.

8. Plans, lead quota and billing

Pricing is based on monthly lead volume. A free Starter plan is available. Paid plans renew automatically each month until cancelled, and prepaid top-up packs add extra lead capacity without changing your plan.

Payments are handled by Razorpay. We never see or store your full card details. Prices are listed in USD with an approximate INR figure shown for convenience; Indian businesses are charged in INR. Taxes, including GST where applicable, are added as required by law.

If you reach your monthly lead quota, capture is limited until the quota resets or you buy a top-up pack. Your existing data stays accessible.

9. Cancellation and refunds

You can cancel a subscription at any time from Billing, and it stays active until the end of the period you have paid for. Refund eligibility is set out in our Cancellation and Refund Policy, which forms part of these terms.

10. Services we rely on

AbhiKai runs on third-party infrastructure and connects to platforms you authorise. Their availability and rules affect the service, and where you connect an account you also accept that platform's terms. The current list is in our Privacy Policy.

11. AI features and their limits

AI features produce suggestions: a priority score, a draft note, a draft reply. They can be wrong, and they are not professional advice of any kind.

Where AI can send something to your customers, you can require human approval first, and we recommend you do until you have watched it work. You remain responsible for what is sent from your account, including what AI drafted. Do not rely on AI output for legal, medical, financial or safety decisions.

12. Availability and support

We aim for high availability but do not promise uninterrupted service on our current plans. Maintenance, third-party outages and events outside our control can cause downtime, and we have not committed to a contractual uptime figure — if you need one, talk to us before you rely on it.

Support is by email during Indian working hours.

13. Our intellectual property

The AbhiKai platform, brand, and everything we create remain ours. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. You may not copy, reverse engineer or create a competing product from it.

If you send us feedback we may use it to improve the product without owing you anything for it.

14. Confidentiality

Each side agrees to protect the other's non-public information, use it only for the purposes of this agreement, and not disclose it except to people who need it and are under similar obligations. This does not cover information that is public, already known, or independently developed.

15. Suspension and termination

You can stop using AbhiKai and delete your workspace at any time. We may suspend or terminate an account that breaches these terms, does not pay, or puts our platform or other customers at risk. Where it is reasonable and lawful, we will warn you first and give you a chance to fix it.

On termination your right to use the service ends. We keep your data for a limited window so you can export it or change your mind, then delete it — the period is in our Privacy Policy.

16. Disclaimers

Except as expressly stated here, the service is provided as is. We do not warrant that it will be error-free, that AI output will be accurate, or that using it will produce any particular business result. Nothing on our marketing pages is a guarantee of sales, rankings or revenue.

17. Limitation of liability

To the extent permitted by law, neither side is liable for indirect, incidental or consequential loss, or for lost profits, revenue, goodwill or data, arising from this agreement.

Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited, including for fraud or death or personal injury caused by negligence.

18. Indemnity

You agree to cover us against claims arising from your content, from your use of the service in breach of these terms, and from your contacting of people without a lawful basis.

19. Changes

We improve the product continuously, and features may change or be retired. We may update these terms; where a change materially reduces your rights we will give reasonable notice by email or in the product. Continuing to use AbhiKai after a change means you accept the updated terms, and the date at the top always tells you which version you are reading.

20. Governing law

These terms are governed by the laws of India, and the courts of Jaipur, Rajasthan have exclusive jurisdiction. We will both try to resolve a dispute by talking first.

21. Contact
